Applicant is in judicial custody in Case Crime No.540 of 2024, under Sections 332, 353, 392, 427, 504 IPC, Police Station- Laksar, District- Haridwar. He has sought his release on bail.

Heard learned counsel for the parties and perused the record.

According to the FIR, the informant, who is a Revenue Sub-Inspector, had visited the house of the applicant, who happened to be the Village Gram Pradhan for enquiring about illegal mining, but the FIR records that during enquiry, the applicant started abusing the Revenue Officers and he started assaulting them with lathi and danda and damaged the documents of the informant and also looted a gold chain.

Learned counsel for the applicant would submit that it is a false case; had the informant received any information with regard to illegal mining, he could have lodged the FIR and could have taken preventive steps; he had no occasion to visit the house of the applicant.

Learned State Counsel would submit that the witnesses have supported the prosecution case.

Having considered, this Court is of the view that it is a case fit for bail and the applicant deserves to be enlarged on bail.

The bail application is allowed.

Let the applicant be released on bail, on his executing a personal bond and furnishing two reliable sureties, each in the like amount, to the satisfaction of the court concerned.
