Ravindra Maithani, J
Applicant Roman Masih is in judicial custody in FIR No.116 of 2023, under Sections 279 & 308 of IPC, P.S. Pantnagar, District Udham Singh Nagar. He has sought to release his bail.
Heard learned counsel for the parties and perused the record.
According to the FIR, on 19.06.2023, the applicant was driving vehicle bearing registration no. UK 4 PA1928. He was driving in a rash and negligent manner under the influence of liquor. When police got this information about it and signalled it to stop, he did not stop. Thereafter, the police got the vehicle stopped at a barrier
Leaned counsel for the applicant would submit that the applicant was driving the vehicle in a right manner. He has driven the vehicle from Haldwani to Rudrapur.
Learned State Counsel would submit that the applicant was driving the vehicle in a rash and negligent manner.
Having considered, this Court is of the view that the applicant deserves to be enlarged on bail.
The bail application is allowed.
Let the applicant be released on bail, on his executing a personal bond and furnishing two reliable sureties, each of the like amount, to the satisfaction of the court concerned.
