Heard learned counsel for the parties with respect to the order dated 30.11.2021 of this Tribunal. Office report has been filed vide date 02.12.2021 in which it has been stated that “unserved notice not received back today. Notices issued on 12.10.2021 to all private respondents O.P. 5 to 13.” Thus, it is clear that notices have been adequately served to all the private respondents. However, no CA has been filed inspite of the opportunity given.
Learned counsel for the applicant submits that applicant has filed a representation dated 23.08.2021 for revision of seniority which is still pending and interest of justice would be served if the same may be decided upon by the concerned competent respondent within a stipulated timeframe at the present stage.
At this, learned counsel for the respondents submits that he would like to file CA but the issue of representation also can be decided by the Court and the representation would be accordingly decided on merits.
Given the facts above, in the interest of justice, it is directed that representation dated 23.08.2021, (Annexure No. A-4) be decided by the competent authority amongst from the respondents by a reasoned and speaking order, in accordance with law within three months of the date of receipt of a certified copy of this order.
It is made clear that no comments as to merits of the case have been passed.
Original Application is disposed of accordingly.
No costs.
