Judgment
We have heard Shri Prakash Shah, the learned counsel for the appellant and Shri Sachin Chandarana, the learned counsel for the respondent
through video conference.
There is a delay of 40 days in filing the appeal. For the reasons stated in the Misc. Application, the delay in filing the appeal is condoned. Misc.
Application No. 326 of 2020 is allowed.
Connect with Appeal No. 106 of 2020 and list for admission and for final disposal on December 8, 2020. Parties will ensure that the record of
Appeal No. 106 of 2020 are scanned and given to the Tribunal on or before the next date.
In the meanwhile, the learned counsel for the respondent may file a reply within three weeks from today. Two weeks thereafter to the appellant to
file a rejoinder.
Considering the facts and circumstances that has been brought on record we direct the appellant to deposit a sum of Rs. 23,16,000/- within four
weeks from today if it has not been recovered from them.
If the amount is deposited the direction of restraining the appellant from taking new clients shall remain stayed during the pendency of the appeal.
The urgency application and the stay application are disposed of.
Parties are directed to take instructions from the Registrar 48 hours before the date fixed in order to find out as to whether the matter would be
taken up for hearing through video conference or through physical hearing.
The present matter was heard through video conference due to Covid-19 pandemic. At this stage it is not possible to sign a copy of this order nor a
certified copy of this order could be issued by the registry. In these circumstances, this order will be digitally signed by the Presiding Officer on behalf
of the bench and all concerned parties are directed to act on the digitally signed copy of this order. Parties will act on production of a digitally signed
copy sent by fax and/or email.
