Judgment
[1] Heard Shri Kh. Santa, learned counsel appearing for the petitioners and Shri H. Debendra, learned Government Advocate appearing for the State
respondents.
[2] According to the petitioners, they are the owners in possession of certain lands situated near Naoremthong Samusang and in the process of
expansion of trans-highway running from Imphal-Tamenglong and onwards, some portions of their lands are being affected and therefore, they have
submitted a representation dated 18-9-2020 followed by a reminder dated 20-11-2020.
[3] According to Shri H. Debendra, learned GA, it is true that the trans-highway running from Imphal-Tamenglong and onwards is being constructed
for which the original road needs to be widened, if possible with the lands belonging to the Government and none of the lands belonging to the
petitioners have been affected.
[4] In view of the rival contentions and the disputed question of facts being involved herein, it is not appropriate for this Court to decide the issue
involved herein. After hearing the learned counsel appearing for the parties for a while, it has been submitted by Shri Kh. Santa, learned counsel
appearing for the petitioners that if that be the case, the State respondents may be directed to consider and dispose of the said representations by
passing an innocuous order and accordingly, the instant writ petition stands disposed of with the direction that the Deputy Commissioner, Imphal West
shall consider and dispose of the representation dated 18-9-2020 followed by a reminder dated 20-11-2020 within a period of two weeks from the date
of receipt of a copy of this order by issuing a speaking order in respect thereof.
[5] Copies of this order shall be sent to the counsel appearing for the parties through their WhatsApp/e-mail.
