Judgment
Heard Mr. I. Lalitkumar, learned Senior counsel appearing for the petitioners and Mr. H. Devendra, learned GA for the State respondents.
[2] The only prayer made in this writ petition is to direct the respondents to consider the representations dated 27.09.2019 and 28.12.2020 submitted to
the Director of Trade, Commerce and Industries, Govt. of Manipur by the petitioners.
[3] According to the petitioners, they are the owners and in possession of certain lands as mentioned in the writ petition, situated at Haffiz Hatta,
Imphal East District, Manipur and they have been paying land revenues.
[4] It is learnt by the petitioner from the reliable source that the State Government executed a Gift Deed on 15.12.2017 thereby gifting a piece of land,
belonging to the petitioners, to the New Checkon Leikai Shinglup of New Chekon, WangkheiKhunou Shinglup of Wangkhei Khunou and Nongpok
Ingkhol Awang Leikai Shinglup of Nongpok Ingkhol Awang Leikai, Imphal East District.
[5] Being aggrieved by it, the petitioners submitted a representation dated 27.09.2019 to the Director of Trade, Commerce and Industries, Govt. of
Manipur requesting him to modify or correct the said Gift Deed to protect their rights and to avoid any conflict between the parties.
[6] During the pendency of the said representation and without solving the problems involved therein, the petitioner learnt that the State Cabinet, in its
meeting held on 15.09.2020 approved the Works Department’s proposal for Construction of Government Residential Quarters at Tribal Colony,
New Checkon, Imphal East including the utilization of 2.26 acres of land at Hafiz Hatta which was meant earlier for Khadi Plaza/Textiles Trade &
Exhibition Centre of the Directorate of Handlooms & Textiles, Commerce and therefore, the Industries Department was to transfer and hand over the
said portion of land to Works Department vide its letter dated 13.10.2020. Being further aggrieved by the said letter dated 13.10.2020, the petitioners
submitted another representation dated 28.12.2020 to the Director of Trade, Commerce and Industries, Govt. of Manipur requesting him to intervene
the matter by bringing an amicable solution in the interest of justice and the same is still pending for consideration.
[7] Being aggrieved by the inaction on the part of the respondents, the instant writ petition has been filed by the petitioners. When the matter is taken
up for consideration, it has been submitted by the learned counsel appearing for the petitioners that the instant writ petition can be disposed of by
issuing an innocuous order and accordingly, the present writ petition stands disposed of with the direction that the respondents and in particular, the
Director of Trade, Commerce and Industries, Government of Manipur shall consider the representations dated 27.09.2019 and 28.12.2020 within a
period of 1(one) month from the date of receipt of a copy of this order by issuing a speaking order in respect thereof.
Copies of this order shall be sent to the learned counsels appearing for the parties through their WhatsApp/e-mail.
