Judgment
A.L. Dave, J.—Heard Mr. S.N. Gajendragadkar, learned Advocate, on behalf of Mr. Dipak R. Dave for the Petitioner and Mr. Joy Mathew, learned Advocate for the Respondent.
It is indicated by Mr. Gajendragadkar, learned Advocate, for the Petitioner that the parties have settled the dispute outside the court and the Respondent has shown his disinclination and disinterest in being reinstated in service and in claiming 75% back wages. He has sworn an affidavit to this effect. He has produced a copy thereof before this Court, which is taken on record.
Learned Advocate Mr. Joy Mathew, for the Respondent also states that the Respondent has received some amount from the Petitioner and the dispute is resolved and the Respondent is now no more interested in opposing this litigation. Mr. Mathew further submits that the Respondent has received all his dues and he is already in business.
In light of the above development, the dispute is settled between the parties outside the court and the Respondent is not opposing the petition, the present petition is disposed of while setting aside the impugned Award dated 20.2.2003, passed by the Labour Court, Ahmedabad in Ref (LCA) No. 1471 of 1995. Rule made absolute with no order as to costs.
