Justice L. Narasimha Reddy:
The respondents issued an advertisement on 12.05.2021 inviting applications for appointment against various posts of Trained Graduate Teachers (TGT) and Assistant Teachers (AT).
The applicant intends to apply for the post of TGT (Natural Science) and Assistant Teacher (Primary). The age limit without relaxation of age stipulated for those posts is 32 and 30 years respectively. The applicants crossed the said age limits. Placing reliance upon certain orders passed by the Government, she claims the benefit of relaxation of age limit.
Today, we heard Shri Khagesh B. Jha, learned counsel for the applicants and Ms. Esha Mazumdar, learned counsel for the respondents.
The issue pertaining to the relaxation of age limit for various posts in the Directorate of Education is no longer res integra. By referring to the relevant Recruitment Rules and the various circulars, this Tribunal took the view that there exists a facility of relaxation of age limit up to 40 years in favour of women candidates in the Recruitment Rules for the post of TGT itself. However, such a facility does not exist in case of Assistant Teachers. The applicant deserves to be treated as within the age limit for the post of TGT (Natural Science) in case, she is below 40 years. However, such a facility cannot be extended to her for the post of Assistant Teacher (Primary).
Hence, the OA is partly allowed directing that the respondents shall be under obligation to extend the relaxation of age limit to the applicant for the post of TGT (Natural Science) up to 40 years. The claim as regards the post of Assistant Teacher (Primary) is rejected. There shall be no order as to costs.
