Learned counsel for the parties are present.
Mr. Rahul Pandey, Advocate appears before this Court along with opposite party No.-2 in person. He undertakes to file Vakalatnama on behalf of opposite party No.- 2 who is present in person today and prays that the matter may be posted in the next week.
During the course of hearing, it transpired that a joint petition for divorce was filed before the Family Court, Ranchi which was numbered as O.S. No. 757/2019 and vide order dated 18.06.2022, the same has been dismissed as infructuous by recording that the petitioner No. 2 i.e., the present opposite party No. 2 has not been appearing for second motion.
Learned counsels for the parties jointly submit that in order to take the compromise to a logical end, now a fresh petition is required to be filed.
Learned counsel for the petitioner submits that his client has come from Patna and is available in Ranchi today. He submits that his client is ready to cooperate, so that the fresh petition, if agreed by the opposite party No.-2, can be filed by tomorrow.
During the court proceedings, the opposite party No.-2 has agreed that she is ready to file a fresh petition tomorrow. Mr. Rahul Pandey, Advocate has submitted that the needful can be done at his chamber today itself at around 12:30 p.m.
Considering the aforesaid submission, the matter is adjourned and is directed to be posted on next Friday i.e., on 05.08.2022.
