Rita Karmakar vs State Of Tripura And Ors.

Mr. K. Chakraborty, learned counsel has appeared for the applicant and shown the following direction in the judgment and order dated 19.11.2018 delivered in WP(C)No.1545 of 2017, by which the said writ petition was disposed of :

"For attending circumstances, the actual financial benefits be granted to the petitioner from 01.07.2008. However, this payment may not be made to the petitioner but be impounded and kept in the GPF Account and which amount may be released after 3(three) years on claim of the petitioner."

Mr. Chakraborty, learned counsel has submitted that for the employees of Tripura State Electricity Corporation Limited (TSECL), no GPF account is opened and as such, the applicant is not getting the benefit of the said direction.

Mr. N. Majumder, learned counsel appearing for the Tripura State Electricity Corporation Limited-respondents has submitted that the said direction may be altered for correcting the apparent error. TSECL is ready to make the payment by cheque.

In view of this, in place of the above direction, the following be substituted :

"For the attending circumstances, the actual financial benefits be granted to the petitioner from 01.07.2008 and the payment be made by the cheque within 2(two) months."

As this will be the part of the original order, 2(two) months would be counted from today i.e. 12.04.2021.

Registry is directed to substitute that part of the judgment by the authority of this order. Apart that, as a measure of abundant caution, this order shall be treated as a part of the order dated 19.11.2018 delivered in WP(C)No.1545 of 2017.

In terms thereof, this application stands allowed.

A copy of this order be supplied to the counsel for the parties.
