Prashant Kumar, J.—This application has been filed for cancellation of appointment of respondent No. 7 on the post of Aangan Bari Sewika of Aangan Bari Centre, Choka. It is stated in the writ application that petitioner is B.A. (Hons.) in Hindi and she has got 51.2% marks in the Graduation, whereas respondent No. 7 has got only 48% marks in the Graduation, but the respondent No. 7 had been appointed on the post of Aangan Bari Sewika. There fore, her appointment is illegal.

A counter affidavit has been filed on behalf of the State, wherein it is stated that on 18.7.2013, a meeting of the Selection Committee held and in the said meeting the qualifications of the candidates considered for appointment on the post of Aangan Bari Sewika. The Selection Committee found that apart from the qualification of Graduation, respondent No. 7 has got other qualifications, such as, certificate in dress making, designing and embroidery issued by the Jan Shikshan Sansthan. She has also got certificate of Bachelor of Science in Library and Information Science. Considering the aforesaid qualifications her name recommended by the Selection Committee and on the basis of aforesaid recommendation, she has been appointed on the post of Aangan Bari Sewika. Annexure-B to the counter affidavit shows that the minimum qualification for appointment on the post of Aangan Bah Sewika is only matriculation. Thus, in my view, only because petitioner has got more marks in Graduation, she is not entitled for appointment. As noticed above, the respondent No. 7 has been appointed on the post of Aangan Bari Sewika, because she has extra qualification than the petitioner. Therefore, I find no illegality in the same. Under the said circumstance, I find no merit in this writ application, accordingly, the same is dismissed.
