Judgment

Present writ petition has been filed under Article 226 of the Constitution for directing respondent Nos. 1 to 3 to protect the life and liberty of the petitioners.
[2] Short reply / status report by way of affidavit dated 06.04.2023 of Sh. Ashok Kumar, DSP, Headquarter Nuh, District Nuh, on behalf of respondent Nos. 1 to 3, has been filed. Same is taken on record and copy thereof supplied to the opposite side.
Registry will do the needful.
[3] A perusal of Para No. 3 of above affidavit reveals that both the petitioners are absconding from their homes and the nephew of petitioner No. 2 has got registered FIR No. 143, dated 16.03.2023, under Section 346 IPC at Police Station Sadar Nuh in this regard. For reference, para No. 3 of the affidavit is re-capitulated as under:-
“3. That the detailed facts emanating from the present case are that after receiving the notice of the present petition, it has been revealed that the petitioner no. 1 and 2 are absconding from their houses. However, the nephew of the petitioners no. 2 namely Anish s/o Sube Khan has got registered FIR No. 143 dated 16.03.2023 section 346 IPC registered in police station, Sadar Nuh regarding for missing of his uncle namely Sehju (petitioner no. 2). The local police has made strenuous efforts to locate the petitioner no. 1 and 2. However, they could not be located as yet.”
[4] Learned State Counsel, on instructions from ASI Inder Jeet, has given an assurance that life and liberty of the petitioners shall be protected in accordance with law.
[5] In view of the above factual position, present petition is disposed off accordingly.
