Judgment
The matter was taken up today through Video Conferencing at 11:30 AM.
Heard Dr. Ram Kumar Mishra, PCMA for applicant/ RP through video conferencing, who has filed the present application U/s 12(2) of IBC with a prayer for extension of CIRP of 90 days period beyond 180 days and also for exclusion of the Lockdown period from 25.03.2020 to 30.06.2020.
Ld. PCMA for the applicant/ RP contends that the CoC in its fourth meeting held on 20.07.2020 had passed the resolution for extension of CIRP with 100% voting shares.
In view of the submission made by the Ld. PCMA for the applicant/ RP, this Court is of the opinion that the extension need to be granted. Accordingly, extension of 90 days period beyond 180 days is granted. The period of Lockdown from 25.03.2020 to 30.06.2020 is hereby excluded.
The present IA No.281/2020 stands disposed off.
