Judgment
Matter was mentioned by Learned Counsel Ms. Sonam Malik for correction in final order dated 30.09.2021, mentioning about the inadvertent non-consideration of fresh Form No. 2 filed and appointment of name of IRP. Learned Counsel states that originally with main application, Form No. 2 of IRP Mr. Atiuttam Prasad Singh was filed but they were informed later on that he is unwilling to take the assignment as he is not keeping well. Hence a fresh Form No. 2 along with the supplementary affidavit was filed and record on 18.08.2021. Inadvertently while passing the final order, the IRP as mentioned in the main application is appointed in the order dated 30.09.2021. Today, Learned Counsel again mentions the matter and after perusal of the other documents, it is seen that fresh Form No. 2 Mr. Mohd. Nazim Khan is filed having registration number IBBI/IPA-002/IP-N00076/2017-18/10207, hence, we cancel the name of Mr. Atiuttam Prasad Khan, as IRP recorded in the order passed on 30.09.2021 and Mr. Mohd. Nazim Khan is hereby appointed as IRP of the Corporate Debtor. The order dated 30.09.2021 shall take effect from today. Let copy be served by registry as well as Learned Counsel for the applicant to the newly appointed IRP.
IRP is directed to act and take all appropriate steps for conducting CIRP as mentioned in the order dated 30.09.2021.
