The applicant retired as Private Secretary from the service of the Ministry of Railways. She filed this OA challenging the Memorandum dated 12.05.22014. Through the said Memorandum, the manner in which the pay scale shall be revised in the context of implementation of the recommendations of the 6th Central Pay Commission (CPC) was indicated. According to the applicant her pay was not revised in terms of the orders issued from time to time, particularly, the Notification in RBE No.103/2008.

We heard Ms. Swati R. K., learned counsel for the applicant at the stage of admission.

The applicant retired from service way back in the year 2016. The Memorandum dated 12.05.2014 was issued while she was in service. That is in the form of clarification of doubts as regards the implementation of the Notification dated 04.09.2008 issued by the Railways.

The applicant contends that though she was extended the benefit of the correct Grade Pay, namely, Rs.4800/-, she was not put in the proper Pay Band. However, except making her grievance, she is not able to demonstrate as to which provision of the notification was violated. Added to all this, the timing becomes an important issue. The applicant did not choose to file the OA while in service, nor immediately after retirement. The recommendations of the 7th CPC were also implemented long back. It would be difficult to undertake any adjudication as regards the implementation of the 6th CPC at this stage.

The OA is accordingly dismissed. There shall be no order as to costs.
