Heard, learned counsel for the parties.
The petitioners claim to be land-losers of the land measuring an area 7.5 Decimals and 3.75 Decimals in Village- Bariya, Thana No.197, Khata No.73, Plot No.42/10.
As per the case of the petitioners, their land had been acquired for construction of widening of road of National Highway Road NH-75 Sekshan-III BHOGU to SANKHA in Beriya Village in Palamau District, for which, no compensation has been paid.
Petitioners have filed an application/ representation before the Respondent No.2 [The Deputy Commissioner, Palamau] under Section 3 H (4) of the National Highway Act, 1956, but the said application/ representation has not been disposed of till date.
It is submitted by learned counsel for the Respondent No.5- NHAI that the competent authority for redressal of the grievances of the petitioners is Respondent No.3.
Under the circumstances, Respondent No.2 [The Deputy Commissioner, Palamau] is directed to refer the matter before the Respondent No.3 [The District Land Acquisition Officer, Palamau] within two weeks of the order and thereafter the Respondent No.3 [The District Land Acquisition Officer, Palamau] shall pass a reasoned order on the same.
Writ Petition accordingly stands disposed of. Pending I.A., if any, stands disposed of.
