The prayers in this OP(CRL.) are as follows:-
“(i) To direct the respondent to dispose of CC.15/2022 (VC.06/2020/KTM) pending before the Hon’ble Enquiry Commissioner and Special Judge (Vigilance) in Kottayam, within a period of 4 months;
(ii) To issue such other order or direction as this Hon’ble Court may deem fit and proper in the facts and circumstances of the case.
(iii) To dispense with filing of the translation of vernacular documents.”
This Court obtained a report from the Special Judge on the time span required for the disposal of the case. The learned Special Judge reported that six months’ time is required for the disposal of the case.
The learned counsel for the petitioner submits that the petitioner, who is a Government servant, is about to superannuate on 31.05.2024. Therefore, the pendency of the matter will affect his future prospects.
Having considered the entire circumstances, the Enquiry Commissioner and Special Judge (Vigilance), Kottayam is directed to dispose of the matter as expeditiously as possible, at any rate, within a period of six months from this day.
The Original Petition is disposed of as above.
The Registry shall communicate the order forthwith.
