Many of the Advocates for the Interveners states that they have not received the copy of the affidavit dated 16th December, 2021 filed by Sri Abhiram Nayak, Under Secretary to Government of Odisha, Fisheries and Animal Husbandry Department.

Mr. D.K. Mohanty, learned Additional Government Advocate (AGA) submits that twenty copies of the said affidavit along with annexures will be provided to the Deputy Registrar (Judicial) within three days. It is up to the learned counsel for the Interveners to collect the copies thereof from the Deputy Registrar (Judicial) before the next date. The response to that affidavit, if any, be filed by the next date.

Mr. D.K. Mohanty, learned Additional Government Advocate submits that the satellite maps for the districts Puri and Khurda and for the Mahakalpada Tehasil, which is under Kendrapara district are available with him. He states that the maps as regards the other two tahasils i.e. Rajnagar and Rajkanika under the same district should be available within the next two weeks. Mr. Mohit Agarwal, the Amicus Curiae (AC) is permitted to inspect the aforementioned maps in the office of Mr. D.K. Mohanty, learned AGA.

Mr. D.K. Mohanty, learned AGA Advocate submits that an affidavit regarding removal of illegal prawn gheries in Krushnaprasad area is being be filed today. Mr. Mohanty submits that the satellite maps in respect of Ganjam district will be provided by the next date.

The learned AC pointed out that in Puri district the problems of re-emergence of illegal prawn gheries soon after their removal, continues. The Collector, Puri who participated in virtual mode admitted that the problem of re-emergence of illegal prawn gheries persists but states that they are receiving regular inputs in the form of satellite maps from Orissa Remote Sensing Agency and that the steps to ensure that non-re emergence of the illegal prawn gheries are being taken. He is hopeful that the problem will be overcome soon. On the next date, the Court will be informed of the steps taken to control the problem.

The Collector, Ganjam states that after receiving photographs of two illegal prawn gheries in Ganjam district from the AC, action have was taken to remove them. He states that FIRs in that regard have been registered.

The Collector, Khurda states that the problems of reemergence of illegal Prawn gheries is under complete control and necessary action taken to patrol the area to ensure that new illegal prawn gheries do not emerge is being undertaken. He is confident that in the next four month all the illegal prawn gheries in Khurda District will be removed. A month wise statement of the removal of illegal prawn gheries from January 2022 onwards will be submitted to the Court on the next date. A list of FIRs registered in that regard will also be submitted.

An affidavit filed by the Deputy Collector (Revenue), Collectorate, Kendrapara has been handed over to the Court. It states that 24 illegal prawn gheries have been demolished between 20th December, 2021 to 17th February, 2022. A balance area of 92.28 acres of illegal prawn gheries are still to be demolished. The Deputy Collector (Revenue), Kendrapara is directed to submit a list of FIRs registered in respect of demolition of prawn gheries and file a further status report on the action taken from 17th February, 2022 till the end of March, 2022 by the next date.

Copy of the objection to the I.A. No.18800 of 2021 filed by the Collector, Puri has been served on Mr. Kar, learned counsel for the Applicant. He is permitted to file response thereto by the next date.

Interim order passed earlier shall continue till the next date.
