This Writ Petition is filed seeking a direction to the respondents to extend the parole granted to the petitioner on 01.07.2026 for a period of one month to enable him to take care of his wife, who is suffering from kidney ailment.

Heard learned counsel for the petitioner and learned Assistant Government Pleader for Home, appearing for respondents No.1 and 2.

Learned counsel for the petitioner submitted that the petitioner's wife is a kidney transplant patient and that there is no other person available to take care of her. It is submitted that the petitioner has filed applications dated 08.07.2026 and 11.07.2026, but submitted on 18.07.2026, seeking extension of the parole for a further period of 90 days. However, no decision has been taken on the said applications. Therefore, the present Writ Petition has been filed.

Learned Assistant Government Pleader for Home has furnished a copy of the written instructions received by him and submitted that the petitioner is required to surrender on 01.08.2026 and that the application seeking extension of parole was submitted belatedly.

Learned counsel for the petitioner has placed on record the medical certificates to establish that petitioner's wife is suffering from a kidney ailment and requires continuous care. Learned counsel for the petitioner has also placed reliance on the judgment of the Division Bench of this Court in Mohd. Irfan Ali v. Mujeebunnisa Begum and others1, in support of his request for extension of parole.

After hearing the learned counsel for both the parties and upon perusal of the material placed on record, this Court finds that the petitioner had submitted his applications seeking extension of parole before the expiry of the parole period. However, the respondent police have neither accepted nor rejected the said applications and have failed to take any decision thereon.

Having regard to the medical condition of the petitioner's wife and considering the humanitarian circumstances of the case, this Court is inclined to extend the parole granted to the petitioner till a decision is taken by the competent authority on the petitioner's applications received on 18.07.2026 seeking extension of parole, in accordance with law. Accordingly, the respondent police are directed to consider and dispose of the petitioner's applications for extension of parole, by passing an appropriate order, expeditiously.

With the above observations and directions, this Writ Petition is disposed of. There shall be no order as to costs.

Miscellaneous applications, if any, pending shall stand closed.
