Heard Learned Counsel for the parties.
This Appeal has been filed against the order dated 14.07.2023 passed on IA 828/KB/2023. The Adjudicating Authority on the IA heard both the parties and directed the IA to be posted for conclusion of arguments on 17.07.2023 on which date, it has been submitted by the parties that hearing has been concluded.
Learned Senior Counsel for the Appellant submits that an order was passed on 21.03.2023 in CP (IB)/ 138(KB)2021 along with IA (I.B.C.)/1020(KB)2022 on which date order was reserved. It is submitted that in pursuance of the order dated 21.03.2023, no order has been pronounced sofar nor the order in IA 828/KB/2023 which was also concluded on 17.07.2023 has been pronounced.
In view of the aforesaid, we are of the view that there is nothing in this Appeal to be considered by this Tribunal and we are not inclined to entertain this Appeal. However, in view of the fact that orders have been reserved on 21.03.2023 and further on IA 828/KB/2023 hearing has been concluded on 17.07.2023, we give liberty to the Appellant to request the concerned Bench to deliver the order as early as possible.
With this liberty, we dispose of this Appeal.
