The learned counsel for the petitioner submits that the petitioner’s name was not mutated in the revenue entry record despite having a registered sale deed in his favour only on the ground that he had not submitted any proof of being an agriculturalist. He submits that the said refusal was challenged before the Collector, Assistant Collector and SSRD being the appellate revenue authority, but the order of the Mamlatdar was upheld. He submits that thereafter now the petitioner has received the certificate from Prant Adhikari, Godhra stating that he is an agriculturist. He submits that he will make a fresh application to the Mamlatdar, Ganteshwar, Distict-Kheda and place on record the said certificate for inclusion of his name.

Mr. Jayneel Parikh, learned AGP submits that if such a fresh application is made by the petitioner, the same shall be considered expeditiously.

In view thereof, the order dated 17.06.2020, 24. 06.2019 and 12.04.2018 by the Mamlatdar, Collector, Assistant Collector and SSRD are set aside. The matter is remanded back to the Mamlatdar for fresh consideration of the application for mutation entry after taking into consideration the certificate issued by the Prant Adhikari, Godhra dated 10.03.2021. The petitioner is permitted to place the same on record by way of an appropriate application before the Mamlatdar, who shall decide the application of the petitioner for entering his name in the revenue record afresh in accordance with law on its own merits.

With the aforesaid direction, the Special Civil Application stands disposed of.
