Ravi Shankar Kumar vs The State of Bihar and Others

The present writ application has been filed for a direction to the Respondent University to hold examination of Bachelor of Ayurvedic Medicine and Surgery i.e. Ayurvedacharya Course of the Ayurvedic College, Gaya of 3rd Semesters of Sessions 1995-96.

The examination of such students were not to be conducted by the Respondent University as the capitation fee taken by the College was said to be more than what was prescribed/approved.

Similar matter relating to different college under the same University, students of which were also suffering in similar way had moved this Court for the same relief and a Bench of this Court by its order dated 26.2.2003 in C.W.J.C. No. 13927 of 2002 disposed of the matter by directing the Vice Chancellor to examine the cases as held in the case of Unni Krishnan and T.M.A. Pai Foundation [reported in 2003(1) PLJR SC (1)] which directly deal with the issue in question and thereafter he was directed to pass necessary orders in the matter in accordance with law. As the future of the students were suffering as such a direction was given to come to a final conclusion within a period of four weeks from the date of receipt/production of a copy of the order.

As it is accepted by the parties that the facts of the aforesaid case is one and the same as such the aforesaid order should be deemed to be the order passed in the present case also and shall govern the present case also and the Vice Chancellor of Kameshwar Singh Sanskrit University is directed to consider their cases also and dispose of the same in accordance with the direction in C.W.J.C. No. 13927 of 2002 within a period of four weeks from the date of receipt/production of a copy of this order.

With the aforesaid direction/observations, this writ application is disposed of.
