Mihir Kr. Jha, J.—Having heard counsel for the parties and taking into account the earlier application dated 28.6.2007, filed by the petitioner after the death of his father on 23.12.2006 was an invalid application in the eye of law, inasmuch as, the petitioner''s date of birth being 2.1.1990 was not major on the date of filing of such application, this Court would give an opportunity to the petitioner to file his fresh application in view of the fact that the period of limitation of five years for filing such application has still not expired. If the petitioner therefore would file an application in the prescribed pro forma with all other requisite details on or before 22.12.2011 as also would place other documents filed with the supplementary affidavit showing that he on being recommended by the authority of B.I.A.D.A. had obtained training for the post of Bio-technician and was also given assurance by the B.I.A.D.A. on 17.11.2009 for being considered for appointment on compassionate ground, the competent authority would take a final decision in this regard within a period of three months from the date of filing of the fresh application and other documents by the petitioner.

Let it be made clear, that this Court has not expressed any opinion on the merits of the claim of the petitioner and has only given a direction to the authorities, to reconsider the matter in the light of their own decision dated 17.11.2009 to consider the case of the petitioner for appointment on compassionate ground as and when the petitioner would complete such training. With the aforementioned observations and directions, this application is disposed of.
