This Criminal Petition, under Sections 437 and 439 of Cr.P.C., has been filed by the petitioner/A-1, seeking regular bail, in Crime No.24 of 2024 of Maredumilli Police Station, Alluri Sitharama Raju District.
A case has been registered against the petitioner herein and others for the offences punishable under Section 8(c) read with 20(b)(ii)(C) of the Narcotic Drugs and Psychotropic Substances Act, 1985 (for short ‘the NDPS Act’).
Heard. Perused the record.
On a perusal of the material available on record, it goes to show that on 22-02-2024 at about 2-45 P.M., the Inspector of Police, Maredumilli Police Station along with his staff and mediators while conducting vehicle checking noticed a Hyundai Xcent Car bearing No.MH 38 V 1943 and found A.1 to A.3 transporting 22kgs of Ganja. After conducting panchanama and after seizing the contraband, he arrested all the three accused, who were remanded to judicial custody thereafter.
The learned counsel for the petitioner contends that the petitioner was arrested on 22.02.2024 and though the statutory period of 180 days have been completed, the police did not file the charge sheet. As such, he is entitled for a statutory bail. Further, learned counsel for the petitioner also contends that A.3 was already enlarged on bail by this court by order, dated 03.08.2024, vide Crl.P.No.5005 of 2024.
On the other hand, the learned Assistant Public Prosecutor confirms the factum of non-filing of charge sheet by the police.
In view of the aforesaid facts and circumstances of the case, this Court is inclined to grant bail to the petitioner/Accused No.1, on the following conditions :
(i) The petitioner herein shall be released on bail on his executing a personal bond for Rs.50,000/- (Rupees fifty thousand only) with two sureties for a like sum each to the satisfaction of the learned Judicial Magistrate of First Class, Rampachodavaram.
(ii) On release, the petitioner shall appear before the Station House Officer concerned twice in a week i.e., on every Monday and Thursday between 10.00 a.m. and 01.00 p.m., until further orders.
(iii) Further, the petitioner is directed not to hamper the investigation and tamper with the prosecution witnesses.
Accordingly, the Criminal Petition is allowed.
