Judgment
Heard the learned counsel for the parties.
The petitioner seeks a direction to the respondents for making payment of Rs. 4 lakhs as Ex-gratia payment to him on account of death of his mother viz. Gita Devi who died during her service as Aanganwari Sevika under the Social Welfare Department, Hathua, Gopalganj in the light of Resolution No. 666 dated 22.08.2015 issued by the Social Welfare Department, Government of Bihar, Patna.
The mother of the petitioner viz. Late Gita Devi was appointed as Aanganwari Sevika at Ghosiya Centre in the Hathua Block of District Gopalganj, who died on 16.03.2019. A certificate of death has been annexed with the petition. It has been asserted that the petitioner is the nearest dependent of the deceased Gita Devi and hence in view of the resolution of the Social Welfare Department, the Ex-gratia payment of Rs. 4 lakhs be given to him at the earliest.
The petitioner, under the aforesaid circumstances, is directed to make a representation within a period of three weeks from today before the Director, Integrated Child Development Scheme, Bihar, Patna (respondent no. 2), who, on receipt of the representation shall verify the facts with respect to the petitioner being the nearest kith and kin of the deceased Aanganwari Sevika, and pass/caused to be passed order in accordance with law within a further period of eight weeks thereafter.
With the aforesaid direction/observation, the writ petition is disposed of.
