Judgment
Hon’ble Mr. Manish Garg, Member (J):-
M.A. No.4379/2026
The present M.A. is filed seeking permission of joining together in a single application.
For the reasons stated therein, the M.A. No.4379/2026 is allowed.
M.A. No.4380/2026
For the reasons stated in the M.A., the present M.A. for exemption is allowed and disposed of being just an exception.
O.A. No.3425/2026
In the present Original Application, filed under Section 19 of the Administrative Tribunals Act, 1985, the applicants hahave prayed Central Administrative Tribunalfor the following relief(s):
“A. Declare and hold that the Typing Skill Test conducted by Respondent No.1/DSSSB on 27.07.2026 in respect of clerical/typing posts under Post Code 802/23 in respect of Serial Nos. 1, 3, 5, 7, 9, 11, 12 and 14 of Post Code 802/23 was conducted in an unfair and arbitrary manner, insofar as the examination interface materially differed from the official Mock Test/interface made available by Respondent No.1 without any prior intimation to the candidates;
B. Quash and set aside the aforesaid Typing Skill Test insofar as the Applicants and the aforesaid clerical/typing posts at Serial Nos. 1, 3, 5, 7, 9, 11, 12 and 14 are concerned, and direct Respondent No.1/DSSSB to conduct a fresh Typing Skill Test for the Applicants by employing a fair, uniform and clearly disclosed examination interface, after providing the Applicants a reasonable opportunity to familiarise themselves with the actual interface/module to be used in the re-conducted test through an official Mock Test.
C. Direct Respondent No.1/DSSSB and/or the concerned examination agency to preserve and produce before this Hon'ble Tribunal all relevant records pertaining to the official Mock Test and the actual Typing Skill
Test applicable to Serial Nos. 1, 3, 5, 7, 9, 11, 12 and 14 of Advertisement No. 05/2023, including the software/module versions and configurations, interface specifications, system and application logs, candidate session records, start/end time records, technical incident reports, audit trails, records of any modification or configuration of the scrolling functionality, communications/instructions exchanged between Respondent No.1 and the examination agency concerning the Typing Skill Test module, andsuch other technical records as may be necessary for determining the difference between the official Mock Test and the actual examination interface.
D. Direct Respondent No.1/DSSSB not to finalize or give consequential effect to the result of the Typing Skill Test insofar as the Applicants and the clerical/typing posts at Serial Nos. 1, 3, 5, 7, 9, 11, 12 and 14 are concerned, and not to take any irreversible consequential steps affecting the Applicants' candidature pursuant thereto, during the pendency of the present Original Application, subject to such further orders as this Hon'ble Tribunal may deem fit.
E. Pass such other or further order(s) or direction(s) as this Hon'ble Tribunal may deem fit and proper in the facts and circumstances of the present case and in the interest of justice.”
At the outset, learned counsel for the applicants submits that representations of the applicants (Annexure A-7) regarding technical issue faced during the Skill/Typing Test for the post of LDC/Junior Assistant (Post Code: 802/23) and request for re-conduct/rescheduling of the examination. He further submits that the applicants would be satisfied if a direction is issued to the respondents to dispose of the aforesaid representations by way of a reasoned and speaking order within a prescribed time frame.
Issue notice. H A Khan and Mr. Amit Anand, learned counsel appear and accept notice on behalf of the respondents. Learned counsel for the respondents seek some time to obtain appropriate
instructions.
In view of the limited prayer made, without entering into the merits of the case, the present O.A. is disposed of with a direction to the respondents to consider and decide the aforesaid representations of the applicants (Annexure A7) by passing a reasoned and speaking order, strictly in accordance with law, within a period of thirty 30 days from the date of receipt of a certified copy of this order.
The OA is disposed of in the aforesaid terms, without going into the merits, at the admission stage itself. Pending MAs, if any, shall also stand disposed of accordingly. No order as to costs.
