Judgment
S.R. Brahmbhatt, J.—Heard learned Counsels for the parties at length.
Shri Shethna, learned advocate appearing for the complainant has submitted that the complainant is in fact very much aggrieved by the insult and conduct, which he had to suffer and therefore, the complaint is filed. He submits that the complainant is ready and willing to withdraw the complaint if the applicants through their counsel express regret for the conduct and if such regret is expressed, than, the complainant would not hold them in any manner nor would the applicants sue for filing such complaint.
In view of this, Shri A.D. Shah, learned advocate appearing for the applicants submit that the dispute before the Charity Commissioner is already settled and compounded, however, in order to put an end to controversy, he on behalf of his clients i.e. present applicants under instructions submits that the dispute needs to be put to an end appropriately and in view of the complainant''s submission through counsel, they express their sincere regret that such an incident had happened. This expression is without entitling any one to claim any advantage on this basis nor would the complainant nor the accused would get any benefit out of this.
In view of this, the complaint is quashed and proceedings of Criminal Case No. 5616 of 2003 is quashed. Petition is allowed. Rule is made absolute.
