The challenge in the present writ petition is made to the final merit list of Gram Kachahari Sachiv, Barheta under Gram Panchayat-Barheta, Block Bankey Bazar, District Gaya, which was duly prepared and published on 12.03.2025.

While assailing the final merit list, it is submitted that the Niyojan Samiti failed to consider the claim of the petitioner for her selection on the ground of Graduation and Post Graduation marks sheet send by way of Online within the stipulated period. Non-consideration of the academic qualification of the petitioner is resulted into selection of non-deserving candidate. The petitioner also raised her grievance before the District Panchayat Raj Officer, Gaya on 12.04.2025 giving all the details, but no action has been taken, hence the present writ petition.

Considering the submissions advanced and taking note of the fact that there is provision for statutory appeal under Rule 7 of the Bihar Gram Katchahry Secretary (Employment, Service Conditions and Duties) Rules, 2014, this Court instead of directing the State to ensure filing of the counter affidavit deems it fit and proper to dispose of the writ petition with a liberty to the petitioner to file an appropriate appeal before the District Panchayat Raj Officer, Gaya preferably within a period of four weeks from today.

Since the petitioner had already filed an application, raising her grievance before the competent authority, the copy of which is marked as Annexure-P/7, hence the limitation in filing of such appeal shall be condoned and it is expected that the authority concerned shall consider the case of the petitioner on merit and pass final order within a further period of eight weeks thereafter.
