Judgment
Heard Mr. Raju Datta, learned counsel appearing for the appellant as well as Mr. Ratan Datta, learned P.P., appearing for the State-respondent.
This application has been filed by the petitioner under Section 438 of the Code of Criminal Procedure for granting anticipatory bail to the accused-petitioner who has been evading arrest in connection with Kakraban Police Station Case No.2017 KKB 066 under Sections 307/326/379/34 of IPC.
Mr. Ratan Datta, learned P.P., submits that in the instant case, charge-sheet has already been submitted on 14.05.2020 under Section 307 and 326 of IPC before the learned Chief Judicial Magistrate.
In view of the above, the petitioner is directed to appear before the concerned Court with an application for granting bail. In the event of filing such application by the petitioner, the concerned Court on the consideration of the fact that during the course of investigation, the petitioner was not arrested and charge-sheet has already been submitted, the bail application may be disposed of in accordance with law.
With the above observation and direction, the instant bail application stands disposed of.
