Notice. Mr. Y.P.S.Daulta, learned Additional Advocate General, appears and waives service of notice on behalf of the respondents.
Heard.
The petitioner is stated to have completed his normal tenure at the present place of posting i.e Govt. Senior Secondary School Chobia, District Chamba, H.P, a tribal area. He seeks transfer to a soft area of his choice in accordance with law and applicable Transfer Policy. Petitioner’s representation dated 07.07.2023 (Annexure P-3),made in this regard to respondent No.2 is yet pending consideration.
Learned counsel for the petitioner submits that petitioner would be content in case, the petitioner is permitted to submit a fresh representation seeking his transfer to a soft area, in accordance with law and applicable Transfer Policy, to respondent No.2, whereafter, respondent No.2 be directed to decide the said representation, in a time bound manner.
In view of above submissions, the instant writ petition is disposed of by permitting the petitioner to make a fresh representation to respondent No.2, within a week from today, who shall in turn, consider and decide the same, in accordance with law and applicable Transfer Policy, within a further period of three weeks by passing a reasoned order, which shall also be communicated to the petitioner. Pending miscellaneous application(s), if any, shall also stand disposed of.
