This is a bail application U/S.483 of BNSS by the petitioners for grant of bail in connection with Khariar PS Case No.43 of 2026 corresponding to ST Case No.08 of 2026 pending in the file of learned Additional District and Sessions Judge, Khariar, for commission of offences punishable U/Ss.109(1)/118 (1)/126(2)/296/351(3) of BNS, on the main allegation of attempting to the life of the injured Bhima Patel by assaulting his neck with a knife.
In the course of hearing, Mr. Satya Narayan Mishra-4, learned counsel for the petitioner submits that the petitioner has already been remained in custody for six months and in the meantime, charge-sheet has already been submitted with framing of charge against the petitioner and, therefore, the petitioner may kindly be granted bail.
On the other hand, Mr. P. Satpathy, learned Additional Public Prosecutor by placing the injury report of the injured prays to reject the bail application of the petitioner.
After having considered the rival submissions upon perusal of record, there appears allegation against the petitioner for attacking the injured by cutting his neck and the injury report of the injured reveals that he had sustained grievous injury on his neck and there was fracture of maxilla, zygomatic arch and mandible bone. In the aforesaid facts and circumstances of the case and on consideration of materials placed on record, this Court is not inclined to grant bail to the petitioner.
Hence, the bail application of the petitioner stands rejected. Accordingly, the BLAPL stands disposed of. A copy of this order be immediately transmitted to the learned Court in seisin over the matter.
