These are bail applications U/S.483 of BNSS by the petitioners for grant of bail in connection with Jaleswar PS Case No.216 of 2026 corresponding to CT Case No.259 of 2026 pending in the Court of learned JMFC, Jaleswar for commission of offence punishable U/Ss. 117(2)/ 115(2)/ 118(2)/ 126(2)/ 296/ 109(1)/ 3(5) of BNS, on the main allegation of attempting to commit murder of the injured Haripada Manna by assaulting him with a knife.
Heard, Pravash Chandra Jena, learned counsel for the petitioners; Mr. M.R. Patra, learned Addl. PP and Mr. Sankar Prasad Pani, learned counsel for the informant appearing virtually in BLAPL No.6011 of 2026 and perused the record.
After having considered the rival submission upon perusal of record, there appears allegation against the petitioner Chandan Baskey @ Chandan Kumar Baskey for assaulting the injured by means of a knife, but there is no such allegation against the petitioners- Madan Mohan Sahoo and Kanhei Charan Mahala. The injured has in fact sustained one laceration injury on his neck and the Doctor has opined that such injury can be caused by sharp object. Besides, the petitioner Chandan Baskey @ Chandan Kumar Baskey is having three criminal antecedents, but the same has not been disclosed in his bail application. In view of the above facts and circumstances and taking into consideration the materials placed on record and regard being had to the main allegation of assaulting the injured by means of knife being directed against the petitioner Chandan Baskey @ Chandan Kumar Baskey, this Court while not being inclined to grant bail to the petitioner Chandan Baskey @ Chandan Kumar Baskey in BLAPL No.6011 of 2026 considers it proper to admit the petitioners Kanhei Charan Mahala in BLAPL No.5861 of 2026 & Madan Mohan Sahoo in BLAPL No.5862 of 2026 to bail.
Hence, the bail application of the petitioner Chandan Baskey @ Chandan Kumar Baskey in BLAPL No.6011 of 2026 stands rejected, whereas the bail applications of the petitioners Kanhei Charan Mahala in BLAPL No.5861 of 2026 & Madan Mohan Sahoo in BLAPL No.5862 of 2026 stands allowed and the petitioners Kanhei Charan Mahala & Madan Mohan Sahoo is accordingly allowed to go on bail on furnishing bail bonds of Rs.50,000/-(Rupees Fifty Thousand) only each with one solvent surety for the like amount to the satisfaction of the learned Court in seisin of the case on such terms and conditions as deem fit and proper by it with following conditions: -
the petitioners shall not contact the injured or his family members; and
The petitioners shall not threaten/ influence/ induce/ coerce any of the witnesses acquainted with the facts of the case so as to dissuade them disclosing such facts before the Court.
Accordingly, these BLAPLs stand disposed of.
Issue urgent certified copy of the order as per Rules. A soft copy of this judgment be immediately communicated to the concerned Court, who shall afterwards communicate the same to the concerned Jail through e-mail for reference.
