Heard the learned counsel appearing on behalf of the petitioners as well as the learned counsel appearing on behalf of the respondent State.

This writ petition has been filed under Article 226 of the Constitution of India for direction upon the authority concerned to issue the rent-receipt and also to quash the notice dated 19.11.2019 in Doubtful Jamabandi Case No.01/19-20.

Mr. Vibhor Mayank, the learned counsel appearing on behalf of the petitioners submits that during pendency of the present writ petition the Doubtful Jamabandi Case was opened which has been challenged by way of amendment and that has been allowed by the order dated 02.08.2022. He next submits that wrongly the Doubtful Jamabandi Case has been initiated however the petitioners are in possession.

The learned counsel for the respondent State submits that once the Doubtful Jamabandi proceeding is there, the petitioners can take all the objections in the said case to find out the prima-facie case, and if the petitioners present their case before authority concerned, proper order can be passed by the authority concerned where the Doubtful Jamabandi Case is pending.

In view of above, at this stage, Mr. Mayank, the learned counsel appearing on behalf of the petitioners, on instruction, seeks permission to withdraw the instant petition with liberty to file the objection in the said proceeding taking all the grounds therein.

In view of the above, this petition is permitted to be withdrawn and disposed of with liberty to the petitioners to file their objection in the said proceeding and once the objection will be filed, the learned authority will decide the same after providing opportunity of hearing in accordance with law.
