The applicant was working as Constable in Delhi Police. He was discharged from the service on account of disability w.e.f. 31.05.2012. He was also sanctioned the service pension. His grievance is that the sanction of disability pension is not being considered.
This OA is filed with a prayer to direct the respondents to sanction him the disability pension. Since there is a delay of about 1800 days, he filed MA No.1224/2020 with a prayer to condone the delay.
We heard Shri G. K. Pathak, learned counsel for the applicant and Ms. Esha Mazumdar, learned counsel for the respondents.
MA No.1224/2020 is filed for condoning the delay of about 1800 days. The reasons stated in the application are hardly convincing. The applicant retired from service on the grounds of disability, way back in the year 2012 and eight years have elapsed. It is not as if he was not sanctioned any benefit or that he was facing any financial difficulty to pursue the proceedings. He is in receipt of financial benefits ever since the date of retirement. The reason for approaching the Tribunal after such a long time is stated to be on account of forgetfulness. Except mentioning that ground, he did not even state as to how the forgetfulness occurred and when it has ceased. Proceedings before the Tribunal cannot be reduced to such a level.
We find it difficult to condone such an enormous delay that too on such a vague and untenable ground. The MA as well as the OA are accordingly dismissed.
