Heard Ms. Khushboo Kataruka, learned counsel for the petitioner, gone through the instant petition and the documents attached thereto. After hearing learned counsel for the petitioner and considering the fact that the unfortunate incident has taken the life of a young boy of hardly 13 years and a student of VIIth Class in Sapphire International School, 12th Milestone Ranchi-Khunti Road, Hardag, Ranchi, Jharkhand, it would be most appropriate if the management of the said school is made as party respondent for the reason that any order passed during the pendency of the instant lis may affect the management of the said school. Ms. Kataruka makes an oral request for impleadment of the said school as party respondent.

Ordered accordingly. Sapphire International School, 12m Milestone Ranchi-Khunti Road, Hardag, Ranchi, Jharkhand is hereby made as party respondent.

Notice to all the respondents including the newly arrayed respondent, returnable within one week only. Service upon newly arrayed respondent shall be effected through Principal, Sapphire International School.

Director General of Police, respondent No. 2 herein, is directed to verify the status of the investigation carried out with regard to the FIR and what action has been taken by the police in nabbing the accused, who was allegedly involved in the commission of this serious offence. Needless to say that along with complete report, copy of the postmortem report attested by the Medical Superintendent of RIMS, copy of the FIR attested by Senior Superintendent of Police of the District, in whose jurisdiction the occurrence has taken place, and all other relevant documents including the statements of the witnesses recorded till date under Section 161, Cr.P.C. or 164, Cr.P.C. shall be provided to the Court for its perusal. Statement of the witnesses shall be provided to the court in a sealed cover, whereas two other documents viz. copy of the post-mortem report and the FIR shall be provided to the learned counsel for the petitioner along with the status report in advance.

List again on 17.02.2016.

We make it further clear that the complete report to be provided to the Court shall be signed by respondent No. 2 (DGP, Jharkhand).

At this stage Mr. H.K. Mehta, learned AAG, appears for the respondent Nos. 1-3. Let service upon respondent No. 4 (newly arrayed respondent) be effected through Dasti summon also, for which requisites shall be provided to the Registry today itself. As requested, copy of the order shall be provided to learned counsel for both the sides during the course of the day under the seal and signature of the Court Master.
