Petitioner’s Writ Petition (S/S) No. 543 of 2019 was disposed of by Writ Court vide order dated 14.03.2019 with a direction to Competent
Authority to take decision on his representation.
This Contempt Petition was filed alleging that no decision has been taken on petitioner’s representation.
Compliance affidavits have been filed by respondent nos. 1 & 2. Annexure No. 5 to the compliance affidavit filed on behalf of respondent no.1 is
the order dated 12.02.2020, whereby decision on petitioner’s representation was taken.
Learned counsel for the petitioner submits that petitioner’s representation has been rejected mechanically, with total non-application of mind.
Be that as it may, the fact remains that decision on petitioner’s representation has been taken. Thus, this Court is of the considered opinion that
it is not a case of willful disobedience of the order passed by Writ Court.
Accordingly, the contempt petition is closed.
Contempt notices issued to the respondents are hereby discharged.
However, petitioner shall be at liberty to challenge the order passed on petitioner’s representation before the appropriate forum.
