Shri Santosh Kumar Tiwari, learned counsel for the applicant, and Shri Rishi Kumar, learned counsel for the respondents, are present.
O.A. bearing Diary no.1227/2021 has been filed assailing an order vide which the applicant was terminated from service. The said order was passed on 14.05.2002. This order came into being on account of the continued absence of the applicant from duty with effect from 2001 onwards. The present O.A. has been filed after a gap of 19 years on 23.03.2021.
The Miscellaneous Application no.979/2021 accompanying the O.A. very cursorily mentions that the delay has occurred on the account of ill-health of the applicant and his weak financial condition. Besides these two general statements, there is no explanation which can justify such an inordinate delay. Moreover, a bare reading of the Original Application and the documents annexed thereto indicate that, probably, the applicant had not even responded to the notice issued to him for his continued absence which led to his further termination form services.
In the absence of any cogent or justifiable reason for such an inordinate delay of 19 years in filing the present O.A., we are not inclined to condone this delay.
Accordingly, M.A.979/2021 and the O.A. bearing Diary no.1227/2021 are dismissed at this initial stage.
No order as to costs.
