Judgment
By filing the present petition, the petitioner seeks a direction to the respondent authorities to consider and decide his pending application for grant of Van Adhikar Patta under the Scheduled Tribes and Other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 in respect of land admeasuring 0.80 hectare situated at Compartment No. P-3414, Village Pipraul, Tehsil Ramanujganj, District Balrampur-Ramanujganj (C.G.). The petitioner has prayed for following reliefs:-
“10.1That, this Hon'ble Court may kindly be pleased to direct the respondent authorities to consider and decided the application /claim filed by the petitioner for grant of Van Adhika Patta of subject land bearing compartment no. P-3414 total area 0.80 hectare situated at, Village Pipraul, Tahsil Ramanujganj. District -Balrampur-Ramanujganj (C.G.) within stipulated period.
10.2Any other relief or reliefs which this Hon'ble Court deems fit and proper in the facts and circumstances of the case may kindly be granted to the Petitioner, in the interest of justice.”
Learned counsel for the petitioner submits that earlier directions were issued for consideration of the petitioner's claim for grant of Van Adhikar Patta; however, the claim has not yet been decided by the competent authority. He further submits that the petitioner has submitted an application dated 07.07.2026 before respondent No. 8, which is still pending consideration. He, therefore, confines his prayer and submits that he would be satisfied if a direction is issued to the respondent authorities to consider and decide the petitioner's pending application within a stipulated period.
On the other hand, learned State counsel submits that he has no objection if the limited prayer made by learned counsel for the petitioner is granted and the pending application is directed to be decided within a reasonable period, in accordance with law.
Having heard learned counsel for the parties and considering the material available on record, it is apparent that the application/claim submitted by the petitioner for grant of Van Adhikar Patta is pending consideration before the competent authority. In view of the limited prayer made by learned counsel for the petitioner, this Court deems it appropriate to dispose of the present writ petition with a direction to the competent authority to consider and decide the petitioner's pending application dated 07.07.2026, in accordance with law, within a period of 60 days from the date of receipt of a certified copy of this order.
It is made clear that this Court has not expressed any opinion on the merits of the claim of the petitioner.
With the aforesaid observations and directions, the instant petition stands disposed of. No order as to costs.
