Judgment

This is first application filed u/s. 439 Cr.P.C. for temporary bail filed by the applicant â€" Ramlakhan S/o. Sant Ram Yadav who has been arrested
by the police on 19.10.2020 in Crime No.132/2020, Police Station Kharkunwa, District Ujjain for the offence punishable under sections 328, 304, 34 of
IPC and u/s. 49-A(1) (3) of the M.P. Excise Act.
Learned counsel for the applicant submits that the investigation is pending and challan has also not been filed so far. The present applicant was
working in the Chemical Factory from where the spirit said to have been supplied for making the liquor. The owner of the factory has also been
arrested in this case. He further submits that the present application for temporary release has been filed because the marriage of daughter of the
applicant is scheduled on 25.11.2020. In support, invitation card of the marriage has also been filed along with this M.Cr.C.
Keeping in view the marriage of daughter of the applicant, this M.Cr.C. is allowed. It is directed that subject to furnishing personal bond by the
applicant in the sum of Rs.50,000/-(Rupees Fifty Thousand only) with one solvent surety in the like amount to the satisfaction of concerned trial Court,
he shall be released on temporary bail for a period from 23rd November to 30th November, 2020. He shall surrender before the Police on 1st
December, 2020 to go back to the jail.
Before releasing the applicant from the custody temporarily, the jail authorities are directed to medically examine the applicant in order to rule out
the possibility of Covid-19 infections and shall comply with the direction given by the Hon'ble Apex Court in Writ Petition No.1/2020.
