Judgment
The order impugned is dated 1 March, 2002 on C.W.J.C. No. 3142 of 2002 Ramji Singh v. Union of India and Ors.
The Petitioner is a Sepoy in a paramilitary force, the Central Industrial Security Force (CISF). He was posted at the CISF unit in Kahalgaon. From Kahalgaon he was transferred to the aforesaid unit at Raurkela. He had filed a writ petition earlier (C.W.J.C. No. 13840 of 2001) challenging his transfer on the ground that it was pre-mature. On that transfer order the Court did not interfere. A representation, which the Petitioner was permitted to file, had been rejected by the CISF. The second writ petition is against rejecting the representation for not canceling the transfer order.
The learned Judge has declined to interfere in the matter. The Petitioner now has filed the present appeal.
The Petitioner is a personnel in uniform. The fact that he has resisted the transfer and has been twice to the High Court is itself a factor which may tantamount to subversive of discipline in service. The Court is not inclined to interfere with the order of the learned Judge.
Dismissed.
