Heard learned Counsel for the Petitioners.

The learned Counsel for the Petitioners who after taking instruction from the Petitioners submitted that though one of the Petitioner was over aged as per the advertisement and as per the Rules which are under challenge but he has been issued admit card to appear in the ensuing examination for the post of Additional District Judge.

The learned Counsel for the Petitioners relied upon the decision of a Division Bench judgment of this Court delivered in the case of Sanjeev Kumar Sahay and Ors. v. State of Jharkhand and Ors. and connected writ petitions which were decided by a Division Bench of this Court reported in Sanjeev Kumar Sahay and Others Vs. State of Jharkhand and Others,

After going through the reasons given in the said judgement we are of the view that the matter requires consideration. Therefore, issue notice to the Respondent for which requisites etc. must be filed by tomorrow i.e. on 17.06.2011. Rule is made returnable by 20th June, 2011.

Since the examination is scheduled to be held on 19.06.2011 and Petitioners have already approached this Court on 25.02.2011 and one of the Petitioners has already got the admit card to take part in the examination, therefore, the Respondent is directed to allow provisionally the above named Petitioners to appear in the examination on 19.06.2011 which shall not create any right in the Petitioners and there result shall not be declared without permission of the Court.

The Petitioners may submit a copy of this order to the Respondent latest by tomorrow i.e. on 17.06.2011 so that they may be given an opportunity for appearing in the examination.

A copy of this order be given to the learned Counsel for the Petitioners by today itself.
