Judgment
Sujit Narayan Prasad, J
The matter has been heard through video conferencing with the consent of the learned counsel for the parties. They have no complaint about any
audio and visual connectivity.
Mr. R.S.Mazumdar, learned senior counsel appearing for the petitioners, has pressed the writ petition.
Mr. Indrajit Sinha, learned counsel appearing for the respondent Dhanbad Municipal Corporation, at the outset, has submitted that in view of the
repealment of the provision of Section 615(iv) of the Jharkhand Municipal Act, 2011 by way of an enactment of the year 2016, the writ petition has
become infructuous.
Mr. Sinha further submits that the aforesaid enactment would be brought on record by way of an affidavit for which he has sought for adjournment.
Mr. R.S. Mazumdar, learned senior counsel, has not objected to such submission.
In view thereof, let this matter be posted on 02.09.2021.
In the meanwhile, learned counsel for the respondent Dhanbad Municipal Corporation shall bring on record the amendment made in Section 615(4) of
the Jharkhand Municipal Act, 2011 by way of an affidavit.
