Judgment
The original application under Section 14 and 15 of National Green Tribunal Act, 2010 (hereinafter referred to as ‘NGT Act, 2010’) has been registered on a letter petition dated 11.01.2023 sent by Ramesh Kumar Nayar c/o Sri Bikram Keshari Nayak at PO- Marthapure, PS-Bhubana, District Dhenkanal, Pin- 759023, Odisha.
Grievance raised in the letter petition is about illegal sand mining and excavation of minor minerals using heavy machines in violation of environmental laws and norms by Marthapure-1 Sand quarry and other sand quarry lesees functioning at Tehsil, Buhal, Dhenkanal. The mining activities are going on at various places in river bed digging beyond 2.5 to 3 mtrs. deep creating deep trenches in the river bed. The authorities are turning blind eye to the activities and that is why illegal mining activities are going on unabatedly.
In our view, a substantial question relating to environment due to implementation of Scheduled Enactments under NGT Act, 2010 has arisen. However, before taking any further action in the matter we find it appropriate to obtain a factual report for the purpose whereof we constitute a joint committee comprising State PCB, District Magistrate, Dhenkanal and Director, Mines and Geology, Odisha.
State PCB shall be the nodal agency for coordination and compliance of this order.
The committee shall visit the site, collect relevant information and submit factual report within two months.
The said action report shall be submitted before the Registrar, Eastern Zone Bench, Kolkata, by e-mail, preferably in the form of searchable PDF/ OCR Support PDF and not in the form of Image PDF who shall place the matter before Bench for further proceedings/orders.
Registry is directed to transfer record of this matter to Eastern Zone Bench, Kolkata for further proceedings in the matter.
A copy of this order be forwarded to State PCB, District Magistrate, Dhenkanal and Director, Mines and Geology, Odisha by e-mail for compliance.
