Mr. S.K. Laik, the learned counsel appearing on behalf of the appellant submits that the appellant is the owner of the vehicle in question and full liability has been fastened upon the appellant/owner inspite of valid insurance. He submits that this appellant has got no grievance so far as the claimants are concerned and in view of that, only insurance company is the necessary party in the present appeal.

It appears that the name of Mr. D.C. Ghosh, the learned counsel is appearing for National Insurance Company Limited in the cause list. The name of Mr. Alok Lal, the learned counsel is also there in the cause list.

Mr. Alok Lal, the learned counsel submits that copy of the appeal has been served upon him and he has sent the same to the Headquarters and thereafter the Headquarters has appointed Mr. D.C. Ghosh, the learned counsel in the present appeal to appear and it was further pointed out that since a long period, Mr. D.C. Ghosh, the learned counsel is not appearing in the Court and he has also not been able to contact him.

Since, Mr. Alok Lal, the learned counsel is present in the Court and he usually appears for National Insurance Company Limited, the Court requested him to take instruction and appear in the present appeal.

Let this appeal appear on 11.07.2024.

It is made clear that on the next date, no adjournment will be provided to the Insurance Company and if Mr. Alok Lal, the learned counsel will not be able to assist the Court, this appeal will be decided without hearing the National Insurance Company Limited.
