MA No. 3121/2019 for joining together is allowed for the reasons stated therein.

The applicants have filed the present OA, seeking the following reliefs:-

"In view of the above, it is, therefore, most respectfully prayed that the Hon‟ble Tribunal may kindly be pleased to direct the respondents to grant all kinds of leaves (EL, CL, ML, CCL, Maternity and Paternity Leaves etc.) and medical benefits to the applicants including medical health card and tuition fees in view of the finds set out by the Hon‟ble High Court in their various decisions."

Counsel for the applicants states that all the applicants herein are contractual employees working in Sanjay Gandhi Memorial Hospital, i.e., respondent no.2. It is stated by the applicants that they are working on contractual basis but are not being permitted leave and other medical benefits which, they claim, they are entitled to in light of the judgment of the Hon‟ble High Court in the case of Sonia Gandhi & Ors. Vs. Govt. of NCT of Delhi [WP(C) No. 6798/2012) decided on 06.11.2013.

They have also given a representation to the respondent no.2 on 08.10.2018, but the same has not yet been disposed of and hence, this OA.

In view of the above factual situation, without going into the merits of this case, the applicants are directed to submit a detailed and fresh representation to the respondents which shall also include the judgments relied upon by them within a period of 15 days of receipt of a copy of this order. The respondents thereafter shall pass a reasoned and speaking order on the said representation within a period of 90 days of receipt of such representation.

With the above directions, the OA stands disposed of at the admission stage itself.
