Report dated 20.10.2023 has been received from the Court of the learned Adhoc Addl. District and Sessions Judge (FTSC-II), Jajpur wherein it has been stated that the C.T. Special POCSO Case No. 89 of 2020 is posted to 08.11.2023 awaiting receipt of further orders of this High Court in Criminal Misc. Case No. 358 of 2023 where the order issuing NBW passed against the parents of the victim girl has been stayed by this Court. It has also been stated that the parents of the victim girl had been shown in the charge sheet as witnesses, but vide order dated 06.12.2022 the then F.T.S.C. Judge has allowed the petition under Section 319 of the Cr.P.C. filed by the Special P.P. and proceeded against them under Sections 319 Cr.P.C. As the parents of the victim girl did not appear, NBW has been issued against them which they have challenged in the said CRLMC. In the trial till 17.11.2022 four witnesses have been examined out of whom P.W.3 is the informant who was the counselor of Utkal Balashram, Jajpur, P.W.4 is a Section Officer of D.C.P.U., Jajpur, P.W.1 and P.W.2 have not supported the case of the prosecution.
Mr. S.S. Pradhan, learned Addl. Govt. Advocate for the State referring to the order dated 30.01.2023 passed in CRLMC No. 358 of 2023 submits that this Court vide order dated 30.01.2023 while issuing notice has posted the case to 24.02.2023 and also directed that the petitioner shall not be arrested pursuant to the issuance of NBWAs till the next date. Although the case was listed on 24. 02.2023 and the next date indicated in the High Court Website is 20. 03.2023, no further order is available.
List this case on 20.11.2023 to enable Mr. S.S. Pradhan, learned Addl. Govt. Advocate for the State to inform the Court about development, if any, in the CRLMC.
