Judgment
Savitri Ratho, J
This is the second application under Section 439 of the Cr.P.C. of the petitioner in connection with kuchinda P.S Case No. 73 of 2023 arising out of Special GR Case No. 12 of 2023 which is pending in the Court of learned Addl. Sessions Judge-cum- Special Court(Under POSCO Act), Sambalpur, where the petitioner is facing trial for commission of the offences under section 376-AB, 376(2)(1) of the IPC read with section 6 of the POCSO Act.
BLAPL No. 10570 of 2023 filed earlier by the petitioner had been dismissed on 04.10.2023 granting liberty to the petitioner to move for bail afresh after the examination of the victim girl and her parents.
Mr. S. K. Panda, learned counsel for the petitioner submits that the certified copies of the depositions of the victim and her parents have been applied for, but have not been received. He prays for a short adjournment in order to obtain the same.
Ms. S. Mishra, learned Additional Standing Counsel is directed to obtain the case diary.
List the case on 29.01.2024.
In the meanwhile the Registry is requested to call for a report from the learned trial court regarding the present status of the trial.
