The Writ petition has been filed for the following reliefs:

“That the present application is being filed for issuance of an appropriate writ/ writs, order/ orders and direction/ directions to the respondents authorities to reimburse/ grant the cost of construction of three Community toilet i.e. Rs. 4,71,600/- with interest, which has been constructed by the petitioner in different places i.e. i) Bariyarpur Police Station Campus, ii) Aasarganj Hatiya Shed and iii) Bengali Tola, Bariyarpur. Accordingly the petitioner filled several representations to all the respondents concerned but those representations are still pending.”

Heard the Learned counsel for the petitioner as well as the Learned counsel for the respondents.

Admittedly, this is a matter where the petitioner is claiming monetary benefits for the work done by him. However, it is an admitted fact that the Tribunal has been constituted, as per the Bihar Public Works Contracts Disputes Arbitration Tribunal Act, 2008, to arbitrate disputes relating to works contracts to which the State Government or a public undertaking is a party and to provide for matters connected therewith. The dispute is defined under Section 2(e) of the said Act which reads as follows:

"Dispute" means any difference relating to any claim arising out of the execution or non-execution of the whole or part of a contract for works or services or both including the rescinding thereof.

Without going into the merits of the case, this Court directs the petitioner to approach the Arbitral Tribunal, raising all his grounds, within one month from the date of receipt of a copy of this order. In turn, the Tribunal, which has been constituted under the Act of 2008, shall adjudicate the matter on merits within three months from the date of filing of such application by the petitioner, in accordance with law, after giving an opportunity of hearing to the petitioner.

With the aforesaid observations, the Writ petitioner stands disposed of.
