Judgment
Narendra Nath Tiwari, J.—The Petitioner is an accused in the case registered for the offence under Sections 147, 148, 149, 323, 324, 337, 307 of the Indian Penal Code and Section 27 of the Arms Act.
Learned Counsel for the Petitioner submitted that the Petitioner has been falsely implicated in the case; there was mob fight between the members of two community on the eve of Janmashtami; no fire arm injury was found on the person of anybody; the members of both side had sustained injuries; named co-accused-Gullu @ Gullu Singh has been granted bail by this Court in B.A. No. 8519 of 2010; he is in custody since October, 2010; Petitioner is a local permanent resident; there is no chance of his absconding.
Learned APP opposed the prayer for bail of the Petitioner, but, after going through the case diary, has not disputed the contention made by the learned Counsel for the Petitioner.
Regard being had to the facts and circumstances of the case, the above named Petitioner is directed to be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Ranchi in connection with Kotwali (Daily Market) P.S. case No. 614 of 2010, corresponding to G.R. Case No. 3832 of 2010.
