This execution application has been filed in a disposed of matter being Original Application No. 921/2022 disposed of on 05.01.2023 directing the DPCC and District Magistrate, Shahdara to look into the matter. Grievance related to running of a welding shop by landlord of the applicant Ram Niwas Rai S/o Ramhit Rai, A99/72, Main Road, West Gorakh Park, Shahdara, Delhi.

In this application for execution, prayer is for expediting decision in application moved under Section 133 of the CrPC before the Executive Magistrate. This prayer is beyond direction in the main application. It now appears that main dispute between parties relates to tenancy, which issue was not raised in the main application. Since the matter has already been disposed of by this Tribunal vide order dated 05.01.2023, no further order is necessary. The grievance against delaying proceedings by the Executive Magistrate has to be before an appropriate forum in accordance with law. The Tribunal is not concerned with individual tenancy disputes but only substantial issues pertaining to environment. No further order is necessary.

The Application is disposed of.
